Two Primary Statutes

The two most applicable antitrust-related statutes are the Sherman Act and the Federal Trade Commission Act:

  • The Sherman Act provides that every contract, combination or conspiracy that restrains trade or commerce is illegal.

  • The Federal Trade Commission Act prohibits unfair methods of competition, and unfair or deceptive acts or practices, that affect commerce.

These are criminal statutes that each have severe penalties. In addition, private parties can bring civil lawsuits and seek even greater damages.
